The Independent Schools Council (ISC) is seeking a judicial review to contest the Charity Commission’s “public benefit test”. The ISC, which represents half of the nation’s independent schools, said the test was “too narrow and deeply flawed”. Schools will risk losing their charitable status under the test if they fail to offer enough bursaries or public access to facilities.
