There is still legal life in closure threatened John Bosco’s in the Gorbals, the only school to go for opting out twice. The story goes like this.
Parents never managed the first ballot within the three-month statutory period at the end of September and Glasgow City Council agreed to close the secondary at the October break. Undaunted parents went ahead but stuck in another petition on September 17 in case the first was declared invalid.
As everyone ran for QC’s advice, the Scottish Office admitted it had no rules to cover such an eventuality. Parents, advised by the school board to abstain in the first ballot of the first petition, largely did so. They are now voting in the first petition, second ballot. In the meantime, the second petition, first ballot has been declared void.
The school remains open.
