Lords Gill, MacLean and Caplan argue that no matter where teachers work they are in the same branch of the public service and “are subject to a uniform system of national pay and conditions set by a statutory body whose decision is binding on their employers”.

The judges were referring to the old Scottish Joint Negotiating Committee but their view will apply equally to the new Scottish Negotiating Committee for Teachers.
