THE Trades Union Congress claimed a moral victory after the High Court said the Government may have acted unlawfully over parental leave.

However, the TUC is considering appealing against the court’s decision to refer the case to the European Court of Justice - a process which could take up to two years.

Ministers excluded about 2.7 millin parents from the right to take 13 weeks’ unpaid leave before their child’s fifth birthday when they decided to make parental leave apply only to those whose children were born after December 15 1999.

Cherie Booth, the Prime Minister’s wife, represented the TUC during the case before this week giving birth to her fourth child, Leo.
