It is when Brown is turned towards Wilson and moving towards him that Wilson fired shots again. The gunshot wound to the top of Brown's head was consistent with Brown either falling forward or being in a lunging position; the shot was instantly fatal. Brown was unarmed but Wilson claimed he saw Brown’s hand at his waistband which caused him to fear he was armed.
There would be nothing to discuss if the fatal shot hit Brown while he was struggling with Wilson while Wilson was seated in his police car. Brown was assaulting a police officer which is a serious crime, a felony. He was huge enough that he could cause serious bodily harm to Wilson.
It is what happens next, when Wilson gets out of his police car after that altercation is over, that ignites the matter. What sets the community off into a riotous state is that the Ferguson grand jury fails to indict Wilson for any crime whatsoever even though he fires ten more shots directly at Brown.
Wilson’s legal problems start the moment he exits his vehicle. Up till then his actions do not seem inherently unreasonable. But with the shooting he does after exiting his vehicle, the sole question becomes: did Wilson use excessive force against Michael Brown, causing his death? If yes, he’s committed a homicide and should be tried for murder or manslaughter.
